Terms
These Terms of Use (hereinafter referred to as "Terms") set forth the conditions for the use of the services (hereinafter referred to as "Services") provided by the OncallManager administrator (hereinafter referred to as "Administrator") on this app and website. Registered users (hereinafter referred to as "Users") shall use the Services in accordance with these Terms.
Article 1 (Application)
- These Terms shall apply to all relationships between the Users, advertisers, and the Administrator regarding the use of the Services.
- The Administrator may establish additional rules and provisions (hereinafter referred to as "Individual Provisions") related to the use of the Services, in addition to these Terms. Regardless of their title, these Individual Provisions shall form part of these Terms.
- In the event of any conflict between the provisions of these Terms and the provisions of the Individual Provisions mentioned in the previous article, the provisions of the Individual Provisions shall take precedence, unless otherwise specifically stated in the Individual Provisions.
Article 2(User Registration)
- By using the Services, the user is deemed to have agreed to these Terms.
Article 3(Management of ID and Password)
- The user is responsible for properly managing their ID and password for the Services at their own risk.
- Under no circumstances may the user transfer, lend, or share their ID and password with a third party. The Administrator will consider the use of the service by the user to be conducted by the user themselves when the combination of the user ID and password matches the registered information.
- The Administrator shall not be liable for any damage caused by the use of the ID and password by a third party, except in cases where the Administrator is at fault due to intentional actions or gross negligence.
Article 4(Prohibited Activities)
- Acts that violate laws or public order and morals
- Acts related to criminal activities
- Acts that infringe upon the contents of the Services, including copyrights, trademark rights, and other intellectual property rights contained in the Services
- Acts that destroy or interfere with the servers or networks of the Administrator, other users, advertisers, or other third parties
- Acts of commercially using the information obtained through the Services
- Acts that may interfere with the operation of the Administrator's services
- Acts of unauthorized access or attempting to gain unauthorized access
- Acts of collecting or accumulating personal information or other data related to other users and advertisers
- Acts of using the Services for fraudulent purposes
- Acts that cause disadvantage, damage, or discomfort to other users, advertisers, or other third parties of the Services
- Acts of impersonating other users or advertisers
- Promotion, advertising, solicitation, or sales activities on the Services without the Administrator's permission
- Acts intended for meeting an unfamiliar person of the opposite sex
- Acts of directly or indirectly providing benefits to anti-social forces in relation to the Administrator's services
- Any other acts that the Administrator deems inappropriate
Article 5(Suspension of the provision of the Services, etc.)
- The Administrator may suspend or interrupt the provision of all or part of the Services without prior notice to the user if any of the following reasons are determined
- When performing maintenance, inspection, or updates on the computer systems related to the Services
- In the event that the provision of the Services becomes difficult due to unavoidable circumstances such as earthquakes, lightning, fires, power outages, or natural disasters
- In the event that computers or communication lines are disrupted due to accidents
- Any other situation where the Administrator determines that the provision of the Services is difficult
- The Administrator shall not be held responsible for any disadvantage or damage incurred by the user or any third party due to the suspension or interruption of the provision of the Services.
Article 6(Copyright)
- The Administrator may, without prior notice, restrict the user's use of all or part of the Services or cancel their registration as a user or advertiser if the user falls under any of the following categories.
- If the user violates any provision of these Terms
- If the user fails to respond to communication from the Administrator within a specified period
- If there has been no use of the Services for more than one year since the last use
- Additionally, if the Administrator determines that the use of the Services is inappropriate
- The Administrator shall not be held responsible for any damage incurred by the user or advertiser due to actions taken by the Administrator based on this article.
Article 7(Use Restrictions and Cancellation of Registration)
- The Administrator may, without prior notice, delete posted data and restrict the user's or advertiser's use of all or part of the Services, or cancel their registration as a user, if the user or advertiser falls under any of the following categories.
- If the user violates any provision of these Terms
- If it is found that there are false facts in the registered information
- If the user fails to respond to communication from the Administrator within a specified period
- If there has been no use of the Services for more than one year since the last use
- If a copyright infringement is discovered
- Additionally, if the Administrator determines that the use of the Services is inappropriate

The Administrator shall not be held responsible for any damage incurred by the user or advertiser due to actions taken by the Administrator based on this article.
Article 8(Withdrawal)
The user may withdraw from the Services through the withdrawal procedure prescribed by the Administrator.
Article 9(Disclaimer of Warranties and Limitation of Liability)
- The Administrator does not explicitly or implicitly guarantee that the Services are free from any defects, whether factual or legal, including defects related to safety, reliability, accuracy, completeness, effectiveness, suitability for a particular purpose, security, errors, bugs, or infringement of rights.

The Administrator shall not be liable for any damage incurred by the user or advertiser in relation to the Services, unless there is intent or gross negligence. However, if the contract between the Administrator and the user or advertiser in relation to the Services qualifies as a consumer contract, this disclaimer of liability will not apply.
- The Administrator shall not be held responsible for any transactions, communications, or disputes that arise between the user and any third party in relation to the Services.
Article 10(Changes to the Service Content)
The Administrator may change, add, or discontinue the content of the Services with prior notice to the users, and the users agree to this.
Article 11(Changes to the Terms of Use)
- The Administrator may change these Terms without the individual consent of the users.
- The Administrator shall notify the users in advance about the changes to these Terms, including the details of the changes and the effective date of the modified Terms.
Article 12(Handling of Personal Information)
The Administrator will handle personal information obtained through the use of the Services in accordance with the Administrator's "Privacy Policy."
Article 13(Notification or Communication)
Notifications or communications between the user and the Administrator shall be made in the manner prescribed by the Administrator. The Administrator will consider the currently registered contact information as valid and will send notifications or communications to that contact unless the user provides a change of contact information in the manner separately specified by the Administrator. These notifications or communications will be deemed to have reached the user at the time of transmission.
Article 14(Prohibition of Transfer of Rights and Obligations)
The user may not transfer their position under the usage agreement or any rights or obligations under these Terms to a third party, or use them as collateral, without the prior written consent of the Administrator.
Article 15(Governing Law and Jurisdiction)
- The governing law for the interpretation of these Terms shall be Japanese law.
- In the event of a dispute related to the Services, the court having jurisdiction over the location of the Administrator shall have exclusive jurisdiction.
Privacy Policy
The OncallManager Administrator (hereinafter referred to as the "Administrator") establishes the following Privacy Policy (hereinafter referred to as the "Policy") regarding the handling of users' personal information in the services provided by the Administrator on this app and website (hereinafter referred to as the "Services").
Article 1(Personal Information)
"Personal Information" refers to "personal information" as defined in the Personal Information Protection Act, which is information about a living individual that can identify a specific person through details such as their name, date of birth, address, phone number, contact information, or other descriptions. It also includes data related to a person's appearance, fingerprints, voiceprints, and information such as the insurer number on a health insurance card, which can identify a specific individual on its own (personal identification information).
Article 2(Methods of Collecting Personal Information)
- The Administrator will ask for the user's email address as personal information when the user registers for the service.
Additionally, the Administrator will collect location information during the use of the service.
Article 3(Purpose of Collecting and Using Personal Information)
The purposes for which the Administrator collects and uses personal information are as follows
- To provide and operate the services
- To respond to user inquiries (including verifying the user’s identity)
- To contact users as necessary, such as for maintenance or important notices
- To identify and deny access to users who violate the Terms of Use or attempt to use the services for fraudulent or improper purposes
- To enable users to view, modify, or delete their registered information and check their usage status
- For purposes incidental to the above-listed uses
Article 4(Changes to Purpose of Use)
- The Administrator may change the purposes of use of personal information only when it is reasonably recognized that the new purpose is relevant to the original purpose.
- If the purpose of use is changed, the Administrator will notify the user of the new purpose through the method prescribed by the Administrator
Article 5(Disclosure of Personal Information)
- The Administrator shall, upon request from the individual, disclose their personal information without delay. However, if disclosure falls under any of the following circumstances, all or part of the information may not be disclosed. In cases where a decision is made not to disclose the information, the Administrator will notify the individual without delay. A handling fee of 1,000 yen per request will be charged for the disclosure of personal information.
- If there is a risk of harm to the life, body, property, or other rights and interests of the individual or a third party.
- If there is a risk of significantly hindering the proper execution of the administrator's operations.
- If it would result in a violation of other laws or regulations.
- Notwithstanding the provisions of the preceding paragraph, information other than personal information, such as historical data, will not, in principle, be disclosed.
